We, YelyPay , a private limited company having its registered office at “Vilnius, Perkūnkiemio g. 13, LT-12114, Lithuania”, hereinafter referred to as the “Company (where such expression shall, unless repugnant to the context thereof, be deemed to include its respective legal heirs, representatives, administrators, permitted successors and assigns).

The creator of this Privacy Policy ensures a steady commitment to Your privacy concerning the protection of your invaluable information. This privacy policy contains information about the Website www.yelypay.com and the other associated domains owned and purchased by the Company. (hereinafter referred to as the Platform).

To provide Users with the uninterrupted use of the Platform, the Company may collect and, in some circumstances, disclose information about the users, with permission. To ensure better protection of privacy, the Company provides this notice explaining the Company’s information collection and disclosure policies, and the choices Users make about the way User information is collected and used.

This Privacy Policy shall be in compliance with the General Data Protection Regulation (GDPR) in effect from May 25, 2018, and any provisions that may read to the contrary shall be deemed to be void and unenforceable as of that date. If you do not agree with the terms and conditions of our Privacy Policy, including in relation to the manner of collection or use of your information, please do not use or access the Site. ANY CAPITALIZED WORDS USED HENCEFORTH SHALL HAVE THE MEANING ACCORDED TO THEM UNDER THIS AGREEMENT. FURTHER, ALL HEADING USED HEREIN ARE ONLY FOR THE PURPOSE OF ARRANGING THE VARIOUS PROVISIONS OF THE AGREEMENT IN ANY MANNER. NEITHER THE USER NOR THE CREATORS OF THIS PRIVACY POLICY MAY USE THE HEADING TO INTERPRET THE PROVISIONS CONTAINED WITHIN IT IN ANY MANNER.

DEFINITIONS

“We”, “Our”, and “Us” shall mean and refer to the Domain and/or the Company, as the context so requires

“You”, “Your”, “Yourself”, “User”, shall mean and refer to natural and legal individuals above the age of 18 who use the Platform and who are competent to enter into binding contracts.

“Third Parties” refer to any Platform, company or individual apart from the User, and the creator of this Platform, such as Merchants.

“Platform” refers to the Website/Domain created by the Company which provides services of the Company through the use of the Platform.

“Personal Information” shall mean and refer to any personally identifiable information that Company may collect from the User. For removal of any doubts, please refer to Clause 2.

INFORMATION THAT IS COLLECTED

The company is committed to respecting User online privacy. The company further recognizes the User’s need for appropriate protection and management of any Personal Information that is shared with the Company or on the Platform. The Company may collect the following information:

Details of Platform usage for analytics.
Additionally, the Teachers, Masters or the School listed on the platform may approach the User for certain specific data and information that may be private for the User. Such information shared by the User, to the Teachers, Masters or the School; either, through the platform or directly, the Platform nor the Company shall be held responsible or liable for any such information that is shared by the User. This privacy policy also applies to data the Company collects from users who are not registered as members of this Platform, including, but not limited to, browsing behaviour, pages viewed etc. The Company also collects and stores personal information provided by the User from time to time on the Platform. The company only collects and uses such information from the User that is considered necessary for achieving a seamless, efficient, and safe experience that is customized to User needs including:

To enable the provision of services opted for by the User;
To enable the viewing of the content of Users’ interest;
To communicate the necessary account and service-related information from time to time;
To allow you to receive quality customer care services and data Collection;
To comply with applicable laws, rules and regulations;
Where any services requested by the User involves a third party, such information as is reasonably necessary by the Company to carry out User service request may be shared with such third party, as in the example of Payment gateways. The Company also uses Users contact information to send updates on User interests, as indicated by prior activity and to view the content preferred by Users. The Company may also use contact information internally to direct its efforts for service improvement but shall immediately delete all such information upon withdrawal of your consent for the same through the ‘unsubscribe’ button or through an email to be sentadmin@yelypay.com

To the extent possible, the Company provides Users with the option of not divulging any specific information that the User does not wish for the Company not to collect, store or use. Users may also choose not to use a particular service or feature on the Platform and opt-out of any non-essential communications from the Platform.

Further, transacting over the internet has inherent risks which can only be avoided by Users’ following security practices by themselves, such as not revealing account/login related information to any other person and informing the Company’s customer care team about any suspicious activity or where User account has or may have been compromised.

COMPANY USE OF USER INFORMATION

The information provided by Users shall be used to provide and improve the quality of service for all Users.

For maintaining an internal record.

For enhancing the Services provided

For better interaction between the users & merchant or as the case may be.

The Company uses User tracking information such as IP addresses, and or Device ID to help identify Users and to gather broad demographic information and make further services available to you.

The Company will not sell, license or trade User personal information to any third party apart from the parties providing User services as availed by Users’ through, or on, the platform. The Company will not share personal information with others unless they are acting under the Company instructions or the Company is required to do so by law.

Information collected via Company or Platform server logs includes users’ IP addresses and the pages visited; this will be used to manage the web system and troubleshoot problems. The Company also uses third-party analytics, tracking, optimization and targeting tools to understand how users engage with the Platform so that the it can improved and be used to personalize content/provide services according to User preferences.

HOW INFORMATION IS COLLECTED

Before or at the time of collecting personal information, the Company will identify the purposes for which information is being collected. If the same is not identified to Users, Users have the right to request the Company to elucidate the purpose of collection of said personal information, pending the fulfilment of which the User shall not be mandated to disclose any information whatsoever.

The Company will collect and use your personal information solely to fulfil those purposes specified by the Company, within the scope of the consent of the individual concerned or as required by law. The Company will only retain personal information as long as necessary for the fulfilment of those purposes. The Company will collect personal information by lawful and fair means and with the knowledge and consent of the individual concerned.

Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.

EXTERNAL LINKS ON THE PLATFORM

The Platform may include advertisements, hyperlinks to other websites, platforms, content or resources. The Company has no control over any websites or resources, which are provided by companies or persons other than us. The User acknowledges and agrees that the Company is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, services/products or other materials on or available from such Platform or resources. The User acknowledges and agrees that the Company is not liable for any loss or damage which may be incurred as a result of the availability of those external sites or resources, or as a result of any reliance placed by User on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such websites or resources. These external websites and resource providers may have their privacy policies governing the collection, storage, retention and disclosure of User Personal Information that the User may be subject to. The Company recommends that Users enter the external Website and review their privacy policy.

GOOGLE ANALYTICS

The Company uses Google Analytics to help in understanding how Users make use of the Platform and to improve the overall User experience. These cookies follow your progress through the Platform, collecting anonymous data on where a User has come from, which pages are visited, and how long Users spend on the site. This data is then stored by Google to create reports. These cookies do not store User Personal data.

The information generated by the cookie about User access of the Website and/or Platform, including IP address, may be transmitted to and stored by Google on servers in the United States or any other country. Google may use this information to evaluate User’s usage of the website and/or Platform, compiling reports on website activity for the Company and providing other services relating to website activity and internet usage. COOKIES

The Company uses data collection devices such as “cookies” on certain pages of our Website and/or Platform. “Cookies” are small files stored on a User’s hard drive that assist Users in providing customized services. The Company also offers certain features that are only available through the use of a “cookie”. Cookies can also help us provide information which is targeted to User interests. USER RIGHTS

Unless subject to an exemption, Users have the following rights concerning User data:

The right to request a copy of User data which is hold about Users in the Website/ Platform;

The right to request for any correction to any personal data if it is found to be inaccurate or out of date;

The right to withdraw User consent at any time;

The right to object to the processing of personal data;

The right to complain about a supervisory authority.

Where Users hold an account with any of the Company’s services, Users are entitled to a copy of all personal data which is held concerning them. Users are also entitled to request that restrictions on how the Company uses User data in the User account when logged in.

CONFIDENTIALITY

User further acknowledges that the Platform may contain information which is designated confidential by the Company and that the User shall not disclose such information without prior written consent by the Company. User information is regarded as confidential and therefore will not be divulged to any third party, unless if legally required to do so to the appropriate authorities. The Company will not sell, share, or rent User personal information to any third party or use User e-mail address for unsolicited mail. Any emails sent by the Company and/or Platform, will only be in connection with the provision of agreed services, and Users retain sole discretion to seek for discontinuation of such communications at any point of time.

OTHER INFORMATION COLLECTORS

Except as otherwise expressly included in this Privacy Policy, this document only addresses the use and disclosure of information the Company collects from you. To the extent that Users disclose information to other parties, whether they are on this Platform or other sites throughout the Internet, different rules may apply to their use or disclosure of the information that is disclosed to them. To the extent that the Company uses third party advertisers, they adhere to their privacy policies. Since the Company does not control the privacy policies of the third parties, Users’ are subject to ask questions before disclosing personal information to others.

COMPANY DISCLOSURE OF USER INFORMATION

The company may host surveys for survey creators for the Platform who are the owners and users of Users’ survey responses. The company does not own or sell User responses. Anything expressly disclosed in responses will be disclosed to survey creators. Please contact the survey creator directly to better understand how they might share survey responses.

Information collected will not be considered as sensitive if it is freely available and accessible in the public domain or is furnished under any rules made thereunder or any other law for the time being in force.

Due to the existing regulatory environment, the Company cannot ensure that all of your private communications and other personally identifiable information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting and foregoing), we may be forced to disclose information to the government, law enforcement agencies or third parties. Therefore, although the Company uses industry-standard practices to protect User privacy, the Company does not promise, and Users’ should not expect, that personally identifiable information or private communications would always remain private.

As a matter of policy, the Company does not sell or rent any personally identifiable information about Users to any third party. However, the following describes some of the ways that personally identifiable information may be disclosed:

External Service Providers: There may be several services offered by external service providers that help Users use our Platform. If Users choose to use these optional services, and in the course of doing so, disclose information to the external service providers, and/or permit them to collect information about them, then their use of User information is governed by their privacy policy.

Law and Order: The Company cooperates with law enforcement inquiries, as well as other third parties to enforce laws, such as intellectual property rights, fraud and other rights. The Company can (and Users’ authorize the Company to) disclose any information about you, the User, to law enforcement and other government officials as we, the Company, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose the Company or User to legal liability.

ACCESSING, REVIEWING AND CHANGING YOUR PROFILE

Following registration, Users can review and change the information they submitted at the stage of registration, except Email ID and mobile number. An option for facilitating such change shall be present on the Platform and such change shall be facilitated by the User. If Users change any information, the Company may or may not keep track of the old information. The Company will not retain in its files, information the User has requested to remove for certain circumstances, such as to resolve disputes, troubleshoot problems and enforce Company terms and conditions. Such prior information shall be completely removed from the Company databases, including stored ‘back up’ systems. If it is believed that any information, the Company is holding on the User is incorrect or incomplete, or to remove the User profile so that others cannot view it, the User needs to remediate, and promptly correct any such incorrect information.

CONTROL OF USER PASSWORD

The User is entirely responsible for maintaining the confidentiality of their password(s). The User must protect it against unauthorized access of User account and information by choosing the password carefully and keeping the password and computer secure by signing out after use of the Website and/or Platform.

The User agrees not to use the account, username, email address or password of another User at any time or to disclose the password to any third party. The User is responsible for all actions taken with login information and password, including fees. If Users lose control of the password, Users may lose substantial control over personally identifiable information and may be subject to legally binding actions taken on the User’s behalf. Therefore, if the Users’ password has been compromised for any reason, the User should immediately change the password. The User agrees to notify the Company immediately if the User suspects any consistent unauthorized use of their account or access to the password even after changing it.

SECURITY

The Company treats data as an asset that must be protected against loss and unauthorized access. The Company employs many different security techniques to protect such data from unauthorized access by members inside and outside the Company. The company follows generally accepted industry standards to protect the Personal Information submitted to the Company and information that has been accessed.

However, as effective as encryption technology is, no security system is impenetrable. Our Company cannot guarantee the security of the Website and/or Platform database, nor can the Company guarantee that information provided by the User will not be intercepted while being transmitted to the Company over the Internet.

SEVERABILITY

Each paragraph of this Privacy Policy shall be and remain separate from and independent of and severable from all and any other paragraphs herein except where otherwise expressly indicated or indicated by the context of the agreement. The decision or declaration that one or more of the paragraphs are null and void shall not affect the remaining paragraphs of this privacy policy.

AMENDMENT

The Company’s Privacy Policy may change from time to time. The most current version of the policy will govern the use of User information and will always be at the Platform. Any amendments to this Policy shall be deemed as accepted by the User on their continued use of the Platform.

AUTOMATED DECISION MAKING

As a responsible company, the Company uses automatic decision-making or profiling.

CONSENT WITHDRAWAL, DATA DOWNLOAD & DATA REMOVAL REQUESTS
